Terms of Use

User of CHECK1 CC hereby accepts all the items of “Terms of Use” agreement. User hereby agrees that this Terms of Use agreement shall NOT be applicable to any linked site from CHECK1 CC or any outer service or site.

 A.     Activity prohibited

1.     Violate laws or ordinances, promote or abet illegal acts.

2.     Attack the Server, disturb other Users or unauthorized access to other Users account.

3.     Disturb the CHECK1 CC’s operation or network system.

4.     Infringe honor, credit, privacy rights, publicity rights, copyrights or any other rights.

5.     Slander, threat, any kind of harassments, damage or disadvantage other User or any third party  economically or mentally. CHECK1 CC strongly suggests User NOT posting content that unilaterally attack others (under circumstances hardly any chances or measures to object to the opinion) by specifying User ID, nickname, full name without the person’s consent.

6.     Ethnic, race, gender, age discriminative posts

7.     Post an image or a motion picture of a dead body, a murder scene or any other contents (including photography, illustration, drawing, words or any other methods of expressing) that are generally received as “uncomfortable” or “traumatic”.

8.     Post content (photography, motion pictures, drawing, illustration and any other media) of highly revealing nude (including obscured or in underwear), close-up of breast, rear end, exposed genitals or any other sexually explicit.

9.     Post content (including words) of sexual conduct, genitals, pornography or any other obscene expression.

10.  Link to child prostitution /sex/pornography, porno video downloads site.

11.  Post words or expressions that glorify/promote/agitate suicide, self-injury and drug abuse.

12.  Promote whatsoever deliberate or indeliberate, an encounter aimed for sex and obscene act.

13.  Pre-election campaign, election campaign or any other acts violate the public election law.

14.  Post or transmit the following information on CHECK1 CC:

1)      Commercial advertisement unauthorized by CHECK1 CC or public relations content.

2)      Link to an affiliate site.

3)      Solicit to pyramid scheme, chain letter, MLM or PTR.

4)      Any other information presumed to be inappropriate.

15.  Random messaging

16.  The following inappropriate acts:

1)      Spam – one or teamed Users posts the same or similar content on CHECK1 CC’s writable areas or messages such content.

2)      Spam word – one or teamed Users posts an irrelevant or hardly relevant list of words to the category or unusually large size content or words in CHECK1 CC’s writable area.

3)      Spam URL – one or teamed Users posts same URL repeatedly in CHECK1 CC’s writable area or messages such content.

4)      Post content in a language code that is unauthorized by CHECK1 CC.

5)      Any other act that CHECK1 CC assumes “spam”.

17.  Post bank account number to publicly accessible areas of CHECK1 CC such as Diary or Community. CHECK 1 CC strongly suggests Users NOT to post phone number as well.

18.  Buy and sell resale items at higher than the original price. (violation of the  nuisance prevention law) Although non profitable selling/buying or exchanging are allowed, CHECK1 CC suggests NOT dealing with an unspecified User.

19.  Whatsoever intentionally or unintentionally, impersonate other person, disguise as a company or an organization without agency or representation right, disguise as an affiliate or a cooperation of other person or organization.

20.   Collect and store other User’s information

21.  Copy, manipulate, upload, post, transmit or distribute CHECK1 CC’s copyrighted materials without permission.

22.   Holding multiple user accounts.

23.   Sharing one user account with any other person.

24.   Any person under the age of 18.

25.   Inviting unacquainted persons from BBS randomly.

26.   Invite deleted User by violation.

27.   Any acts equivalent to the above items.

28.   Any other acts against public morals.

If above violation found, CHECK1 CC shall modify the content or delete the whole content. CHECK1 CC will notify the User by an e-mail to the registered e-mail account. Even if the User will not confirm the e-mail by any reason, CHECK1 CC will take the above action in accordance with this “Terms of Use”. CHECK1 CC will NOT accept any request or claim regarding the deletion. CHECK1 CC may NOT respond to User’s report immediately if the case is difficult to judge.

 B. User’s information

CHECK1 CC shall reserve the right to check or disclose Users’ registered information, access history or the content of e-mails to any third party in case of the following: Inquired a reference legally by a court, police department and any other judicial or administrative organizations.

1.      Having difficulty in maintaining CHECK1 CC or its system.

2.      Infringe laws and ordinances, this Terms of Use or morally inappropriate.

3.      Protect interests or rights of CHECK1 CC, other User or any other third party.

 C. Indemnification

1. CHECK1 CC shall NOT be liable for Users’ correspondences or activities neither should if a conflict arises between Users or between User and any other party.

2. User acknowledges that all the activities within the access to CHECK1 CC shall be at your own responsibility. If User’s post violates any laws and ordinances or infringes copyrights, the User may be claimed of damages or losses or charged of a criminal responsibility.

3. User hereby agrees that negligence of laws or ordinances or breach of this Terms of Use deemed to be a waiver of the rights, claims, legal actions, lawsuits, lawsuit procedures that the User holds against CHECK1 CC.

4. Posting an image to Profile or Diary shall be solely at the User’s responsibility. User needs to consider the compliance to copyright / portrait right laws and ordinances and the validity to saving or reproduction of the data.

5. CHECK1 CC shall reserve the right to suspend or terminate the service. CHECK1 CC shall NOT be liable for any damages or losses caused by the use of the site or, whatsoever temporary or permanent, unavailability of service.

 D. Confirmation, Jurisdiction

1. Access to the site shall be deemed to be the User’s agreement to all the items of this Terms of Use. CHECK1 CC shall reserve the right to amend this Terms of Use without prior notice or consent. The User’s continuous use of the site shall be deemed to be the agreement to the amendment.

2. This Terms of Use shall be governed by and construed in accordance with the laws of Japan. If any controversy or claim between CHECK1 CC and a User arises under or relating to the transactions contemplated herein, only courts in Osaka Japan shall have jurisdiction to hear and decide such matter.
